Terms of Service

Welcome to Metal Made ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our products and services. By engaging our services or purchasing our products, you agree to the following terms and conditions. Please read them carefully.
1. Custom Fabrication Policy
1.1 Custom Orders: All jobs are custom fabricated to the client’s specifications. As such, no two products are identical. Clients are responsible for providing precise and accurate specifications.
1.2 Non-Refundable and Non-Returnable: Due to the custom nature of our work, we do not offer refunds or accept returns once the job has been completed and collected. Please inspect your order upon collection to ensure satisfaction.

2. Tolerances and Limitations
2.1 Fabrication Tolerances: We allow for a tolerance of 2-3mm on cutting and bending. Variations within this range are considered standard and acceptable.
2.2 Functionality Disclaimer: While we strive for precision in our work, we cannot guarantee the functionality or performance of installed items. Clients are responsible for ensuring compatibility and functionality within their intended use.
3. Client Responsibilities
3.1 Specifications: It is the client’s responsibility to provide accurate measurements, designs, and other relevant specifications. Any errors in provided specifications are the client’s liability.
3.2 Inspection: Clients must inspect their products upon collection. By accepting the product, the client acknowledges that the work meets their specifications and expectations.
3.3 Usage: Metal Made is not liable for damage or issues arising from misuse, improper installation, or failure to follow proper maintenance procedures.
4. Payment Terms
4.1 Full Payment: Full payment is required before commencing any project.
4.2 Deposit: At our discretion, a deposit may be required before commencing any project.
The deposit amount will be outlined in the project quotation.
4.3 Final Payment: The balance is due upon completion of the job and prior to collection or delivery of the products.
4.4 Non-Payment: If payment is not received as agreed, Metal Made reserves the right to withhold the finished product until full payment is made.
5. Warranty and Functionality
5.1 No Functionality Guarantee: Metal Made does not guarantee the functionality or performance of any installed or fabricated items. The Client assumes full responsibility for ensuring compatibility and performance post-installation.
5.2 Material Responsibility: If the Client supplies materials for fabrication, we do not warrant the quality or suitability of these materials for the intended purpose.​
6. Collection and Storage Policy
6.1 Collection Timeline: Clients are required to collect completed work within 7 days of being notified that the job is ready.
6.2 Uncollected Items: If items are not collected within 30 days of notification, Metal Made reserves the right to scrap the items to defray storage costs. No refunds or compensation will be provided for scrapped items.
7. Intellectual Property
7.1 Design Ownership: All custom designs remain the intellectual property of the client unless otherwise agreed upon. Metal Made retains the right to showcase completed projects as part of our portfolio.
8. Dispute Resolution
8.1 Governing Law: These Terms are governed by the laws of the Republic of South Africa.
8.2 Resolution Process: Any disputes arising from these Terms shall first be addressed through good-faith negotiations. If unresolved, disputes may be escalated to mediation or arbitration as agreed by both parties.
9. Amendments to Terms
Metal Made reserves the right to modify these Terms at any time. Clients will be notified of significant changes, and continued use of our services constitutes acceptance of the updated Terms.
